Overview

The residential real estate world was rocked in 2024 by the business-changing lawsuit against the National Association of Realtors® and ensuing settlement. This case forces drastic changes to the way real estate transactions have been conducted. We will explain what happened, the results, and how the standard PAR Agreement of Sale form was forced to change. As well, we will focus on the complexities of residential real estate, where even seasoned attorneys can miss critical details when drafting or reviewing Agreements of Sale. We’ll cover the most common mistakes attorneys make—and how to avoid them—during the negotiation and execution of residential real estate contracts. Through real-world examples and expert guidance, this session will arm you with the knowledge to protect your clients, minimize legal risk, address a changing landscape in agency, and ensure smooth transactions.
