Distracted driving has been called an “epidemic” and we likely see distracted drivers most of the time that we drive. We also see these case in our practices. Learn about the newest and most significant cases involving distracted driving issues- employer-employee relationships, using cellphone data to unlock new theories and extend liability beyond the distracted driver to smartphone and app manufacturers, service providers and punitive damage issues. How do you prove the driver was distracted at the time of the crash, including when you need an expert and what can forensic examination of devices reveal? Can and should auto manufacturers be held liable for failing to design vehicles to provide engineering solutions to some distracted driving collisions?
