What Should I Do? – Ethical Dilemmas and the Duty to Report an Impaired Colleague
These issues are becoming more common as the prevalence rates for impairment due to substance and alcohol misuse, stress, anxiety and depression continue to rise. One out of three lawyers will require some form of treatment for these issues in their careers. Despite these startling statistics, the fear of asking for help remains. Many believe it is the very culture which has been created in the legal profession that has lent itself to the notion that overwork remains the norm and seeking assistance is a sign of weakness.
Dealing with the Temporarily Disabled Lawyer - Why Succession Planning is Vital
Lawyers have an ethical duty to ensure the continuity of client representation, even if they become temporarily disabled. As a result, attorneys must take reasonable steps to protect their clients' interests, which includes having a succession plan in place. This CLE will:
• Discuss ways to plan for and deal with attorneys who suddenly become incapacitated;
• Outline the need for firms and solo practitioners to establish procedures that protect client funds, files, and confidential information during an attorney’s incapacity.

Ellen Freedman, CLM
Ellen serves as the Law Practice Management Coordinator for the Pennsylvania Bar Association. In that capacity she assists PBA’s members with management issues and decisions on the business side of their practice, including areas like technology, financial management and profitability, human resources, marketing, risk management, setting up a practice and so forth. Ellen is founder and President of Freedman Consulting, which assists PA law firms with a full range of issues and projects on the business side of the practice. Ellen holds the designation of Certified Legal Manager through the Association of Legal Administrators (ALA), the credentialing body for the CLM degree. Of the 11,000+ members of the ALA, approximately 300 are certified legal managers. Ellen was one of the first 20 in the nation to have achieved this designation. She holds a Certification in Computer Programming from Maxwell Institute, and a Certification in Web Site Design and a B.A. from Temple University. Ellen was inducted as a Fellow of the College of Law Practice Management in October 2020. Membership in the College is by invitation only. Eligible nominees include those who have made significant contributions to the field of law practice management for over ten years. Since its establishment over twenty years ago, nearly 300 practitioners from 5 different countries have become Fellows of the College. Ellen managed inside law firms for twenty years. Most of that time was spent in a midsize (35+ attorney) firm environment. She launched her consulting practice in 1998 and joined the Pennsylvania Bar Association in 1999. She was a member of the Association of Legal Administrators for over 20 years and founded the Independence Chapter. She is a frequent author and speaker on law firm management issues on a national level.
Jeffrey S. Meyers, M.D., L.Ac.
Jeffrey S. “KD” Meyers, M.D., L.Ac., F.A.A.P.M.R. is a board-certified physician, integrative wellness consultant, and educator with an extensive background in peak performance, rehabilitation medicine, and holistic approaches to medicine, the arts, and spirituality. He received his undergraduate degree from the University of Pennsylvania and his Doctorate in Medicine (M.D.) from the University of Colorado School of Medicine. He received his post-graduate specialty training in Physical Medicine and Rehabilitation at the Hospital of the University of Pennsylvania. He is a Diplomate of the American Board of Physical Medicine and Rehabilitation, a Fellow of the American Academy of Physical Medicine and Rehabilitation, a Fellow of the College of Physicians of Philadelphia, and a member of the Waring-Eiseman Society for Humanities in Medicine. He received a Certificate in Psychedelic Therapies and Research from the California Institute of Integral Studies (CIIS) where he is a mentor and part of the program staff. He completed ketamine-assisted psychotherapy training through multiple programs. Dr. Meyers is an attending physician at Delaware Back Pain & Sports Rehabilitation Centers in Wilmington, Delaware, where he specializes in musculoskeletal medicine and pain management. He has a private rehabilitation medicine consulting practice specializing in peak performance, resilience, and wellness, and has led a multi-disciplinary team focused on integrative approaches to pain management, and improving quality of life. He works with both private and corporate clients. He teaches internationally on topics related to rehabilitation medicine, stress management/resilience/happiness, yoga/Ayurveda, acupuncture, somato-typology/constitutional diagnosis/body reading, meditation, and somatic practices. For the past 30 years he has led seminars and classes that explore the interrelationship of biology and consciousness to the arts, sciences, and spirituality.
Daniel J. Siegel, Esq.
Attorney Daniel J. Siegel is a nationally recognized authority on ethics, technology, data protection and business workflow management, and the principal of both the Law Offices of Daniel J. Siegel, LLC and Integrated Technology Services, LLC. Dan provides techno-ethics counsel to solo, small and mid-sized law firms on cybersecurity, technology and other related issues. His practice includes representing of attorneys in disciplinary matters; providing professional responsibility guidance to attorneys and firms; serving as appellate counsel; and representing individuals in workers’ compensation and personal injury matters. Dan also consults with law firms and businesses on workflow management, implementation of paperless offices, and other productivity matters. Attorney Siegel is a prolific speaker and author, and serves as the Chair of the Pennsylvania Bar Association Committee on Legal Ethics and Professional Responsibility, and Past-Chair of the American Bar Association’s Professional Development Board Chair. The author of 15 books, Dan is a columnist and frequent lecturer on a wide range of topics, including ethics, technology, substantive law, appellate law, and professional responsibility matters. Brian S. Quinn, Esq.
Mr. Quinn is a licensed attorney in Pennsylvania who currently serves as the Education and Outreach Coordinator for Lawyers Concerned for Lawyers of Pennsylvania, Inc., a Lawyers Assistance Program established in 1988 for the purpose of helping lawyers, judges and law students recover from alcoholism, drug addiction and mental health disorders. Mr. Quinn obtained his undergraduate degree in 1970, his law degree in 1973 and a certificate in Drug and Alcohol counselling in 2012, from Villanova University. Prior to his work with Lawyers Concerned for Lawyers, he was a private practitioner for over 40 years and has also worked in the field of Alcohol and Drug Counseling in suburban Philadelphia. Mr. Quinn is a past member of the Board of Directors of Lawyers Concerned for Lawyers of Pennsylvania and served as a peer volunteer for over six years prior to accepting his current role as the organization’s Educator in 2017. He has written and presented on lawyer wellness topics to law firms, Bar Associations and legal education providers for state, national and international groups as well.
