Overview

Many elder and estate law attorneys prepare Advanced Directives for their clients.  This course examines the intersection of legal and medical considerations when preparing these documents and the efficacy of the documents when encountered in a clinical setting such as a hospital or emergency medical situation.

Faculty

Jeanne Kerwin

Dr. Kerwin holds a national Health Care Ethics Consultant certification from the American Society of Bioethics and Humanities and has been a leader in bioethics since the 1980’s at Atlantic Health System, serving as Chair of the Ethics Committee and Manager of Bioethics and Palliative Care for a five-hospital system. She was a founding partner in the hospital-based palliative care program beginning in 2002 and has personally provided bedside bioethics and palliative care consultations to hundreds of patients, families, and medical staff over the past 30 years. She has been a leader in the State of New Jersey and nationally in the development of bioethics training for EMS professionals, long term care staff, hospital staff, eating disorder treatment centers and the intellectual/developmental community. She serves as faculty for the NJ Hospital Association’s Annual Ethics Training for Hospital Ethics Committee members in an effort to standardize the role and function of ethics committees throughout New Jersey and neighboring states. She is a frequent speaker for national conferences on ethical issues in medical care as well as palliative care and advance care planning. She has served on multiple state committees including the NJ Health Decisions Ethics Committee for those with Developmental Disabilities, the Governor’s Council on EMS, the Medical Society of NJ’s Bioethics Committee, the End-of-Life Committee for the Elder Law Section of the NJ Bar, the NJ State POLST Task Force, the Governor’s Council on End of- Life Care in NJ and most recently, she serves as co-chair of the American Clinicians Academy on Medical Aid in Dying, Ethics Consultation Service. She was the developer and leader of NJ’s first initiative for out-of-hospital DNR orders in 1997 and the crafting of education for the POLST initiative in 2013. Concurrent with her work in bioethics and palliative care, she was the Director of Emergency Medical Services for Atlantic Health System and a practicing mobile intensive care paramedic for 25 years. Dr. Kerwin holds a Doctor of Medical Humanities and Bioethics from Drew University, a Certificate in Bioethics and Medical Humanities from Columbia University and is a Faculty Scholar in the Palliative Care Education and Practice program at Harvard Medical School. She remains a faculty member for the Graduate Program in Medical Humanities at Drew University as she continues her work as a consultant in the field of health care ethics.

Marianne E. Kreisher, Esq., NCG, CELA

Ms. Kreisher is a Partner at Kreisher Marshall Associates, LLC in Bloomsburg, where she practices in the areas of elder law, estate planning and administration, guardianship, special needs planning and estate litigation. She earned her B.A. from Penn State University in 1993 and graduated cum laude from Widener Law School in Harrisburg in 1996. Following law school, Ms. Kreisher worked in the Pennsylvania Attorney General’s Office for eight years as a deputy attorney general handling criminal appeals, grand jury investigations and criminal prosecutions. Ms. Kreisher is a certified elder law attorney (CELA) by the National Elder Law Foundation as well as a National Certified Guardian by the Center for Guardianship Certification. She is a member of the Pennsylvania Academy of Elder Law Attorneys, National Academy of Elder Law Attorneys, the National Guardianship Association, the Pennsylvania Guardianship Network, the Life Care Planning Law Firms Association, and she serves as the Vice-Chair for the Council of the Elder Law Section of the Pennsylvania Bar Association. Ms. Kreisher has served as adjunct professor at Central Penn College and is a regular presenter for the Pennsylvania Bar Institute continuing education programs. She is the President of the Bloomsburg Area School Board, and Past President of the Bloomsburg Kiwanis Club and Columbia/Montour County Bar Association.
