About

PBI continues its annual focus on contracts by addressing the cutting edge developments in law that affect both contract drafting and enforcement. While much of the technology is new, contracts continue to play a key role in almost every area of law. While the basic principles remain the same, the needs, practice, and parlance vary according to industry and/or area of law. This advanced program will feature plenary sessions that will present and review the all-important basics and sessions that will delve into six specific types of contracts. Consistent with past programs, ethics issues will be referenced throughout the program, with a particular focus on ethics issues in its own session.

Sessions Include:

"Lawyers are from Mars, Clients are from Jupiter:” Advanced Drafting & Negotiation Techniques and the Holistic Approach, and Understanding the Client’s Perspective.

Selected Issues in LLC Formation and Operations*

"Not your Grandparents' Contract Law—Distinctive Challenges for the 21st Century Practitioner”: Contracting by Emoji, Text, Email, and the Internet; Drafting Unilateral Modifications of Consumer and Employment Contracts; Drafting Force Majeure Clauses post-COVID

Business in Human Rights: Understanding the Acronyms of ESG, CSR, and the Opportunities and Risks in Supply Chain and Financing Contract Clauses

Indemnification New and Repackaged: Old Wine in New Bottles?

Ethics in the Real World and Contract Drafting: Wellness; Technology, Competency, and the Limits of Engagement and Representation

All attendees will receive the course book as a digital download.

Recorded in August 2023.
