Joshua D. Waterston, Esq., CIPP/US, AIGP
Josh Waterston is a senior attorney with Wilftek. He practices intellectual property and technology law, focusing on the intersection of technology, privacy, and security. He enables clients to leverage information technology, especially cloud computing, while mitigating their legal and financial exposure. He helps clients take advantage of opportunities created by new technology without falling into hidden traps. Wilftek works with clients of all sizes (one-person startups to Fortune 500 to Global 10,000). Prior to joining Wilftek, Josh was associated with two other law firms, practicing intellectual property and technology law. He has represented clients in Federal copyright, trademark, and patent infringement litigation. During the first part of his career, Josh litigated well over 30,000 civil and criminal cases from trial through appellate stages. He served as Chief Counsel of the Delaware County Office of Support Enforcement, managing the law office of Pennsylvania’s third-largest child support agency and leading a program which collected over $3 Million in overdue child support. Josh is admitted to practice in Pennsylvania state courts, as well as the United States District Courts in the Eastern, Middle, and Western districts of Pennsylvania. He is certified by the International Association of Privacy Professionals (IAPP) as a Certified Information Privacy Professional (CIPP/US) and an Artificial Intelligence Governance Professional (AIGP). He is a member of the Delaware County Bar Association, the Pennsylvania Bar Association, and the Pennsylvania Intellectual Property Forum. He is a current member and former board member of the Cloud Security Alliance – Delaware Valley Chapter. He has taught at continuing legal education seminars on family law, technology and ethics, and intellectual property law, including issues of generative artificial intelligence and intellectual property rights. Devin J. Chwastyk, Esq.
Mr. Chwastyk is the Chair of the Privacy & Data Security group of McNees Wallace & Nurick LLC and practices in its Harrisburg, Pa. office. He began working on cybersecurity issues in 2005, when he represented banks to recover credit card replacement costs from national retailers who failed to safeguard such information in some of the first successful data breach lawsuits in U.S federal courts. Today, Mr. Chwastyk counsels clients on policies and procedures to limit the risk of data exposure events and advises clients on compliance with federal, state, and international privacy laws, including the California Consumer Protection Act and the EU GDPR. He also helps businesses respond to data breaches, including in rectifying and reporting those events and in limiting their potential liability for such events. Mr. Chwastyk has earned two Certified Information Privacy Professional designations (CIPP/US and CIPP/Europe) from the International Association of Privacy Professionals. He received his B.A. from The Pennsylvania State University and his J.D., cum laude, from Georgetown University Law Center.
Nicole M. Danner, Esq.
Nicole M. Danner advises and counsels U.S., international, and non-profit businesses of diverse industries in a range of matters encountered in day-to-day operations. Ms. Danner takes a uniquely practical, business-focused approach because she understands her clients are looking for solutions, not roadblocks. In the data privacy and security space, she helps clients navigate the rapidly evolving data privacy legal landscape and mitigate their risks by developing data security and privacy policies, internal procedures, breach and incident response plans, and the like. Ms. Danner is a Certified Information Privacy Professional for the United States (CIPP/US) as certified by the International Association of Privacy Professionals. Before joining Wisler Pearlstine, Ms. Danner served as in-house counsel for a global market leader in electrical engineering, electronics and automation. In this role, she provided legal services in such areas as contract drafting and negotiation, data privacy, domestic and international regulatory compliance, risk management, and intellectual property. This in-house experience provides Ms. Danner with a unique perspective and approach, offering practical advice to help her clients achieve their business goals.
Dr. Jennifer K. Wagner, Esq.
Jennifer K. Wagner, JD, PhD has been practicing law as a sole practitioner in Centre County, PA since 2007 and has served as an active member of the PBA Cybersecurity and Data Privacy Committee since 2018. In addition to her law practice, she is assistant professor of law, policy, and engineering and anthropology at Penn State University where she teaches multidisciplinary courses (such as Datafied Cultures & Privacy Law) and leads research focused on the intersection of the international human right to privacy, science, and health. Prior to joining Penn State, Jennifer conducted ethical, legal, and social implications (ELSI) research at Duke University’s Institute for Genome Sciences & Policy, the University of Pennsylvania’s Center for the Integration of Genetic Healthcare Technologies, and Geisinger’s Center for Translational Bioethics & Health Care Policy. As a 2014-2015 AAAS Science & Engineering Congressional Fellow, she assisted with science and privacy policy issues in a US Senator’s office. Her scholarly work has been published in prominent legal and scientific journals as well as cited by the Supreme Court of the United States. Jennifer’s professional memberships include the Centre County Bar Association; Pennsylvania Bar Association; American Bar Association; American Society of Law, Medicine, and Ethics; American Association for the Advancement of Science; American Society of Human Genetics; and IEEE Society on Social Implications of Technology. Allison Prout, Esq.
Allison is a member of the Constangy Cyber Team and specializes in data privacy and contractual security requirements, and represents clients in high-stakes technology transactions involving intricate regulatory and business needs. She focuses her contracting practice on a wide range of IT-related areas, including software as a service (SaaS), infrastructure as a service (IaaS), platform as a service (PaaS), professional services, software, licensing, data survey, hosting, and other agreements. Allison counsels clients on a variety of national and international privacy regimes, including the General Data Protection Regulation (GDPR), state privacy and consumer protection laws (including the California Consumer Privacy Act (CCPA)) the Gramm-Leach Bliley Act (GLBA), the Children’s Online Privacy Protection Act (COPPA), the Family Educational Rights and Privacy Act (FERPA), New York Education Law 2-D, and industry best practices. She has experience developing organizational contracting practices for companies, both domestic and international, spanning multiple jurisdictions. She also assists clients in drafting specialized data privacy and security programs that adhere to legal requirements and offer workable solutions for organizational objectives. In addition, Allison advises clients on required employee and consumer-facing privacy notices and obligations, including employee privacy notices, website privacy policies, and associated data subject request requirements.
