Faculty

Jeffrey Rosenthal Esq.

Mr. Rosenthal is a partner with Blank Rome LLP where he leads the Firm’s Biometric Privacy Team.  Mr. Rosenthal concentrates his complex corporate litigation practice on consumer and privacy class action defense, consumer fraud, data privacy, online and telemarketing, false advertising, and e-commerce. He and his team have achieved dozens of dismissals before any answer or motion-practice, early judgments on the pleadings and/or summary judgments (before discovery), and defeated class certification on behalf of major manufacturers, retailers, media companies, healthcare providers, financial companies, and sports franchise and technology companies for over fifteen years.  In addition, Mr. Rosenthal counsels clients on regulatory and statutory compliance with state and federal privacy laws, as well as other consumer privacy matters. He has also written about and been widely published on class action trends, and serves as the Cyberlaw columnist for The Legal Intelligencer. He can be reached at jeffrey.rosenthal@blankrome.com.

Adam Appleberry

Mr. Appleberry is an
attorney in Tucker Arensberg’s Business and Finance Group and is a member of
the firm’s Mergers & Acquisitions and Healthcare practice groups. His
practice focuses on the representation of corporate and medical clients in a
wide variety of legal matters. Prior to joining Tucker Arensberg, Mr.
Appleberry held a myriad of in-house positions in various industries ranging
from logistics to manufacturing to healthcare information technology. Having
worked as a business executive prior to entering private practice, he has a
unique insight into the challenges that impact the overall operation of a
business. Mr. Appleberry applies his experience combined with his advanced
business education to provide practical, business-oriented legal advice. In
his transactional practice, Mr. Appleberry drafts and negotiates contracts,
represents clients in M&A transactions, and advises on general legal
matters. He focuses on representing physicians, physical therapists,
dentists, nurse practitioners, and physician assistants in his healthcare
practice. Mr. Appleberry received his law degree from the University of
Missouri, School of Law. He also has a Master of Business Administration from
the University of Missouri’s Trulaske College of Business. As a graduate of
the United States Military Academy at West Point, Mr. Appleberry spent the
first five years of his career as a U.S. Army officer and is an Iraq war
veteran. As a result, he has a passion for helping veteran-owned businesses.
Mr. Appleberry is licensed to practice in Pennsylvania and Missouri.

Salvatore Rotella Jr., Esq.

Mr. Rotella is a shareholder at Buchanan Ingersoll & Rooney PC, and practices in the firm’s Health Care Section and in its Philadelphia office. He represents health care providers in a broad range of contracting, regulatory, and reimbursement matters, including negotiating network agreements and in connection with in-network and out-of-network reimbursement disputes with public and commercial payors. He also advises providers on general health care billing and compliance issues, and on privacy law requirements. He frequently represents behavioral health care providers and ambulatory surgical centers in particular. Before joining Buchanan Ingersoll, Mr. Rotella served as Chief Compliance Officer & Regulatory Counsel for the D.C. Department of Mental Health and as a trial attorney for the U.S. Department of Justice. He was also in private practice with two other national law firms in Philadelphia and a third in Washington, D.C. He earned his J.D. from the University of Pennsylvania Law School and his B.A. from Harvard University, and served as a law clerk to the Honorable Boyce F. Martin, Jr. on the United States Court of Appeals for the Sixth Circuit.

David Sokolow Esq.

Mr. Sokolow is a partner and Co-Chair of the Health Law Group at Fox Rothschild LLP. Practicing in the Philadelphia and Princeton, New Jersey offices of the firm, he counsels and represents hospitals and health systems, physicians and medical groups, independent practice associations, allied health professionals, skilled nursing facilities, ambulatory surgery centers, diagnostic imaging facilities, home health and rehabilitation agencies, clinical laboratories, medical equipment suppliers, health care management and consulting companies, and other entrepreneurial and institutional health care clients. His practice concentrates in a variety of regulatory and transactional areas, including fraud and abuse and physician self-referral, health care compliance programs and third party payor audits, provider and facility licensing, reimbursement and payment issues, Medicare and Medicaid, certificate of need and health planning, managed care, physician-hospital relations, accountable care organizations and integrated delivery systems, and health care affiliations, joint ventures and contractual arrangements, including clinical co-management, medical practice leasing and super-groups. Mr. Sokolow’s experience also includes appearances before Medicare’s Provider Reimbursement Review Board and other health-care related litigation. He has served as a director of the Pennsylvania Society of Healthcare Attorneys, and is a member of the American Health Lawyers Association, the Health Care Compliance Association, the Pennsylvania Bar Association’s Health Care Law Committee, the American Bar Association’s Health Law Section, the New Jersey State Bar Association’s Health and Hospital Law Section, and the Philadelphia Bar Association’s Health Law Committee. He has written extensively and has spoken on health care issues in a variety of venues. Mr. Sokolow received his B.A. from Carnegie Mellon University in 1988 and his J.D. from Temple University in 1992 following graduate studies at the University of Pennsylvania. Mr. Sokolow has been named one of the leading healthcare attorneys in Pennsylvania and New Jersey by Chambers USA, and he has been AV rated by Martindale Hubbell and selected for inclusion in the Best Lawyers in America for health care law.

Ruth Siegel Esq.

Ms. Siegel practices exclusively in the field of health law. Her practice includes representation of institutional and individual health care providers in business and regulatory matters. Ms. Siegel received a B.A. from the University of Pennsylvania, a J.D. from the University of Pittsburgh, and an M.P.H. from The Johns Hopkins University. Before entering private practice, Ms. Siegel served as Chief Counsel for the Pennsylvania Department of Health (1982-1985). A Past President of the Pennsylvania Bar Institute, she has served as course planner, lecturer, and author for many PBI health law courses. Ms. Siegel and Edward Shay were the originators and course planners for the first Health Law Institute held in 1995. The Health Law Institute has been held every year since 1995. 

Mark Mattioli Esq.

Mr. Mattioli is a shareholder in Health and FDA Business Practice of Greenberg Traurig, LLP in the Philadelphia office. He concentrates his Health Law practice in the areas of antitrust, privacy, fraud and abuse, credentialing, HITECH/HIPAA and commercial litigation involving healthcare providers. His practice includes representation of, among others, clients in antitrust litigation, class action litigation, fraud, false claims act, breach of contract and negligence claims where he has dealt with the discovery of electronic evidence in a variety of different contexts. He has written on a wide variety of topics, including antitrust law, health law, the false claims act, and aviation law. 

Andrea Kahn-Kothmann Esq.

Ms. Smith is the
Senior Associate Counsel and Vice President, Employee and Labor Group for
UPMC. At UPMC, she leads a team of employment, labor law and business
immigration specialists charged with addressing employee-related issues that
arise throughout the UPMC Health System. Immediately before joining UPMC, Ms.
Smith worked at American Airlines in Fort Worth, TX as a Managing Director
and Employment Law Counselor focusing on employment issues arising within
Texas, the US Eastern and Southern states and throughout the Caribbean, Latin
America and Europe. In addition to her legal practice, she has led various
diversity and inclusion efforts throughout her career including: Manager of
American Airlines’ Minority Counsel Program, Working Committee Member for the
national Call to Action committee and LDLC programs, Executive Sponsor –
Legal Department for UPMC’s Corporate Employee Experience team and manager of
UPMC’s Minority Counsel Program. A Pittsburgh native, Ms. Smith graduated
from Spelman College and Emory Law School in Atlanta, GA. She serves on the
Board of Directors for the Urban League of Greater Pittsburgh, the Sarah
Heinz House, and the Association of Corporate Counsel, Western PA Chapter.

Robin Nagele Esq.

Ms. Nagele is a Senior Cousel with Post & Schell, P.C. and a member of its Health Care Practice Group. She has a national healthcare litigation and consulting practice, in which she represents, healthcare providers and their medical and executive leadership  in complex medical staff injunctive and damages litigation, credentialing/privileging strategic planning and dispute resolution, exclusive contracts, economic credentialing, board and physician conflicts of interest, medical staff appointment/reappointment criteria and processes, medical staff closures, intra-hospital corrective action and fair hearing processes, medical staff/board governance, strategic planning and fiduciary oversight. Ms. Nagele’s healthcare consulting and compliance practice covers a wide range of federal and state regulatory issues, including anti-kickback, Stark and other fraud and abuse issues, not-for-profit governance, licensing requirements, federal and state payor regulations, EMTALA, HIPAA, HCQIA, and Patient Safety and Quality mandates. Ms. Nagele counsels and represents federally listed Patient Safety Organizations (PSOs) and participating providers with regard to legal compliance and privilege protection under the federal Patient Safety Quality Improvement Act (PSQIA) and state privilege protections. Ms. Nagele speaks nationally on healthcare issues for the American Health Lawyers Association, Pennsylvania Bar Institute, and The Governance Institute, and has written extensively for national publications. She served as Chair of AHLA’s Medical Staff, Credentialing and Peer Review Practice Group. In 2016, Ms. Nagele was honored by The Legal Intelligencer as one of the “Top 25 Women in the Law”. She is AV Preeminent peer review rated with Martindale-Hubbell, has been recognized by Best Lawyers in America in its 2020-2023 editions in the category of Health Care Law, and is listed in Who’s Who in America. Ms. Nagele is a graduate of Harvard Law School. 

Michael Cassidy Esq.

Mr. Cassidy, a shareholder in the Business and Finance Department of Tucker Arensberg, P.C. in Pittsburgh, concentrates his practice in health care law, chairs the firm’s Business Department, and is a member of the Healthlaw and Employee Benefits Practice Groups. For more than 30 years, Mr. Cassidy has devoted his practice primarily to the representation of physicians and other individual providers and is counsel to the Allegheny County Medical Society. His practice includes the fundamental business transactions and reimbursement issues relating to the formation and governance of healthcare entities and integrated delivery systems, compliance and credentialing, IT Privacy and security. He has extensive experience in third party reimbursement, managed care contracting, fraud and abuse, corporate compliance, telehealth issues, tax exempt organization issues and HIPAA. Mr. Cassidy has been named as one of Pennsylvania’s Super Lawyers for Health Care Law since 2006, and has been named in America’s Best Lawyers for Healthlaw since 2009. He also received the Pennsylvania Bar Association’s “Excellence in Health Care Law Award” for 2003. He is the publisher of the Med Law Blog (www.medlawblog.com). Mr. Cassidy is a member of the Health Care Compliance Association (HCCA) and is certified in Compliance. Mr. Cassidy is a member of the American Health Lawyers Association, its Physician and the Medical Staff, Credentialing and Peer Review (MSCPR) Practice Group, and served as Chair of the MSCPR Practice Group and a member of AHLA’s Quality Council. He is a past chairman and Council member of the Allegheny County Bar Association Health Law Section and a past board member of the Pennsylvania Society of Healthcare Attorneys. He is also a member of the Pennsylvania Bar Institute’s Health Law Advisory Committee. He has written and lectured on health law issues for the American Health Lawyers Association, the Pennsylvania Bar Institute, the Health Care Compliance Association, the Healthcare Financial Management Association (HFMA), and numerous state and county medical societies and bar associations. Mr. Cassidy also served on the Pennsylvania Bar Association’s Health Care Malpractice Task Force. He is the author of “Immunity for Credentialing Decisions Under Federal and State Law” from the AHLA Health Lawyers’ Expert Series, a co-author of the AHLA Peer Review Guidebook, and of chapters on Health Care Contracting and Business Crimes for the Matthew Bender Health Law Treatise, and the Lexis Health Care Compliance Manual. Mr. Cassidy is licensed to practice in Pennsylvania and West Virginia and is admitted to the U.S. Supreme Court, the U.S. Tax Court, the Pennsylvania Supreme Court and various federal courts. He received his B.A. from Brown University and his J.D. from the University of Pittsburgh School of Law. He has an AV rating in the Martindale-Hubbell Law Directory, which is the highest rating for legal ability and ethical standards awarded by this national directory of lawyers.

Danielle Bangs MHA, Director

Danielle has more than 10 years of experience in healthcare consulting and corporate development. She has consulted to health systems, community hospitals, academic medical centers, behavioral health providers, health plans and CINs/ACOs. Her client work focuses on mergers and acquisitions, joint ventures, and other transactions, as well as a range of strategic, financial, valuation and business planning initiatives.

Nicole Aiken-Shaban Esq.

Ms. Aiken-Shaban is a partner at the Philadelphia office of Reed Smith LLP, practicing in the area of health care regulatory law. Her practice focuses on handling reimbursement, regulatory and transactional matters, such as advising on state and federal fraud and abuse laws, developing and navigating value-based care models and payment programs, and structuring complex transactions and contractual arrangements, for a variety of health care industry clients, including health care providers and suppliers, private equity funds and other investors in the health care industry, commercial and managed Medicare and Medicaid managed care organizations, and pharmaceutical manufacturers and biotech companies. She is currently a member of the Philadelphia Bar and American Health Lawyers Associations, and serves as an At-Large Member of the Executive Committee for the Philadelphia Bar’s Business Law Section and Co-Chair of its Health Law Committee. Ms. Aiken received her J.D. from the Drexel University Thomas R. Kline School of Law and her B.A. from the University of New Mexico.

Daniel Shay Esq.

Mr. Shay is an attorney with Alice G. Gosfield and Associates, P.C. His practice is restricted to health law and health care regulation focusing primarily on physician representation, fraud and abuse compliance, Medicare Part B reimbursement, and HIPAA compliance in the physician context. He also has a keen interest in intellectual property issues, including copyright, trademark, data control, and confidentiality. Applying this interest to the firm’s practice focus, he is especially involved in issues of provider ownership and control of their data, software license agreements, and the developing world of sharing and interface of healthcare data systems and the data within them. Mr. Shay received his Bachelor of Science degree cum laude in 2000 from Vanderbilt University and his juris doctorate degree from Emory University School of Law in 2003. Mr. Shay is a member of the Pennsylvania Bar and the American Health Law Association.
